Terms of Service

These Terms of Service (“Terms”) govern your use of ClaimShow, an AI-powered property damage estimation platform operated by Founder 8 Strategic Risk & Capital Advisory Inc. (“we”, “us”, or “ClaimShow”). By creating an account or using the service, you agree to these Terms.

1. What ClaimShow Does

ClaimShow uses artificial intelligence to analyse photos and information you provide about property damage and generate an estimated repair cost in a format comparable to an Xactimate report.

2. Eligibility

You must be:

• At least 18 years of age.
• Legally authorised to enter into a binding contract in your jurisdiction.
• Using the service for lawful purposes related to a genuine property damage claim or professional estimate.

3. Your Responsibilities

• Accurate data.You agree to provide accurate and complete information. Submitting false or exaggerated damage information to influence an insurance claim is fraud — we will cooperate fully with any related investigation.
• Authorisation. You must own the property being assessed or have explicit permission from the owner to submit photos and details about it.
• Account security. You are responsible for keeping your account credentials confidential. Notify us immediately at info@claimshow.com if you suspect unauthorised access.
• No misuse. You must not use ClaimShow to scrape data, reverse-engineer the AI, conduct automated testing without permission, or access any area of the service you are not authorised to use.

4. Subscription & Payments

• Payment processor.Payments are processed by Square. Your billing information is governed by Square’s terms and privacy policy.
• Billing cycle. Subscriptions are billed monthly or annually, depending on the plan you choose. Charges are taken at the start of each billing period.
• Cancellation. You may cancel at any time. Your access continues to the end of the current billing period. We do not issue prorated refunds for partial periods unless required by law.
• Price changes.We will give you at least 30 days’ notice of any price increase, by email and in-app. Continued use after the effective date constitutes acceptance.
• Taxes. Prices shown are exclusive of applicable taxes (GST/HST). Taxes are added at checkout based on your billing address.

5. Intellectual Property

ClaimShow’s software, AI models, branding, and documentation are owned by Founder 8 Strategic Risk & Capital Advisory Inc. and are protected by copyright and other laws. You receive a limited, non-exclusive, non-transferable licence to use the service for its intended purpose.

You retain ownership of the photos and information you submit. By uploading them, you grant us a licence to use that content to provide and improve the service as described in our Privacy Policy.

6. Disclaimer of Warranties

ClaimShow is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, uninterrupted, or that any estimate will achieve a specific outcome with your insurer.

7. Limitation of Liability

To the maximum extent permitted by applicable law, ClaimShow and its directors, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or claim settlement shortfalls, arising from your use of (or inability to use) the service.

Our total aggregate liability for any claim arising under these Terms will not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim; or (b) CAD $100.

8. Indemnification

You agree to indemnify and hold harmless ClaimShow from any claim or demand arising from your use of the service, your violation of these Terms, or your submission of false or misleading data.

9. Termination

We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. You may delete your account at any time from Settings. Sections 5, 6, 7, 8, and 10 survive termination.

10. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts of Alberta.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you by email and in-app at least 30 days before material changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
